If you received a notice from DPS that your license will be suspended or revoked, we might be able to stop the suspension, but you NEED TO ACT QUICKLY. You have 20 days from the date of the letter (not 20 days from the date you receive the letter) to request a hearing. Suppose you fail to request a hearing within 20 days from the date of the letter. In that case, you will not be able to contest the hearing, and your license will be suspended for the period stated in the letter or revoked indefinitely until you correct the issues that led to the revocation.

Your license can be SUSPENDED for many reasons, including:
  • DPS receives notice that you were driving while your license was suspended, canceled, disqualified, or revoked (for example, a conviction for a traffic ticket is reported to DPS or your name appears as a driver on an accident report);
  • you have too many points on your driving record (also known as a habitual violator; four (4) or more convictions for separate incidents in one year, or seven (7) or more convictions for different incidents in two years);
  • you have been determined to be habitually reckless or negligent;
  • you have two or more separate convictions related to restrictions imposed on your license;
  • you have two or more moving violations in one year, and you are under 18 years of age;
  • you were the at-fault driver in an accident that resulted in serious personal injuries or serious property damage; or
  • you flee from an officer.
Your license can be REVOKED for many reasons, including:
  • you have an unresolved out-of-state citation;
  • DPS believes you are incapable of operating a motor vehicle (called a medical revocation)
  • you are believed to have been the at-fault driver in a motor vehicle collision, did not have insurance at the time of the accident, and have not made any restitution for the damages caused by the accident.

If you retain one of our traffic ticket attorneys to contest the proposed license suspension or revocation, we can look for a legal reason to have the suspension or revocation set aside, which is a negative finding. If we cannot obtain a negative finding, we can request that the suspension be probated (typically for a shorter duration than DPS is requesting) so you can continue to drive during your suspension. If we cannot get a negative finding or a probation offer, we can appeal the judge’s decision or apply for an occupational driver’s license so we can keep you driving. Proposed License Disqualification (CDL Drivers)

If you have a commercial driver’s license (CDL), you may have received a disqualification letter. The disqualification letter is notice that you will be disqualified from operating a commercial vehicle for a certain period. Depending on the underlying reason for the disqualification, we may be able to fight the disqualification so you can continue to drive a commercial motor vehicle. The disqualification usually does not affect your ability to drive a personal vehicle during the period you are disqualified from operating a commercial vehicle.
